Public consultation and consideration of submissions

The Regulation was placed on public exhibition between 9 May 2013 and 3 June 2013. The consultation process was in line with the Subordinate Legislation Act 1989 and requirements of the Better Regulation Office (in the Guide to Better Regulation).

The consultation process resulted in 12 submissions to which the Trust responded and has subsequently considered in the final changes to the Regulation. These resulted in amendments that will better define or clarify particular terms or clauses; ensure that authorised persons such as the police have the power to remove persons who do not comply with directions from Trust lands, and permit a marine vessel to moor at the sea wall of Farm Cove in the event of an emergency.

The feedback received also confirmed that the Trust’s position on regulating personal trainers on its lands is reasonable and consistent with public opinion.

The Trust notes that some of the submissions received, while not directly influencing the proposed Regulation, will require communication initiatives and policy changes to ensure that the Regulation is interpreted and implemented appropriately.
