The Royal Botanic Gardens and Domain Trust is committed to encouraging the use and enjoyment of the Trust lands.

Our objectives include; promoting and increasing the educational, historical, cultural and recreational value of those lands. Services available to our visitors, both recreational and educational, are often operated by the Trust, our Volunteers or our Foundation & Friends.

In some circumstances, these services are publicly sourced through the NSW Government’s open tender procurement processes for delivery and management by experienced and specialised private operators, contractors or third parties.

Periodically, the Trust will advertise upcoming business opportunities to the market on its Home page. We welcome innovative, creative ideas and partnerships that help promote our core objectives and help to enhance visitor experience, use and enjoyment of the Gardens and Domain.

Register your interest – NSW Government Tenders

This is the first of two ways to register your interest; it will inform you of business opportunities released through Government Tenders.

Log onto the NSW Government Tenders website. Follow the prompts, and once you have registered, you can choose to be notified by email when an opportunity becomes available to do business with the Royal Botanic Gardens and Domain Trust.

Register your services opportunity or business initiative

This is the second way to register your interest and tell us about a services opportunity or business initiative that you wish to present to the Trust for consideration.

Individuals and companies can directly approach the Trust by submitting a detailed but straightforward proposal that they believe may assist the Trust to promote and deliver its core objectives; and help enhance visitor experience, use and enjoyment of the Gardens and Domain.

Leases

The Royal Botanic Gardens and Domain Trust can enter into formal leases, both short-term and/or longer-term, for the supply and delivery of goods and services, such as turf supply; waste removal; and food & beverage services for specific events or locations.

Requests for goods and services are typically advertised and sourced through the NSW Government Tender processes for delivery and management by experienced and specialised private operators, contractors or third parties.

At the end of any lease term(s), the Trust will review its ongoing business and operational requirements. As appropriate, it will either prepare new requests to go back out to the open market (using the NSW Government Tender processes) or consider alternate procurement strategies and options.

The Trust is committed to innovative and creative ideas and partnerships that promote and deliver its core objectives and which help to enhance visitor experience, use and enjoyment of the Gardens and Domain.

Licenses & easements

Section 20(C) of the Royal Botanic Gardens and Domain Trust Act 1980 (NSW) requires the Trust to outline the criteria by which the Trust assesses requests or proposals for grants of licences for the use of, or easements through, on or in, Trust lands. Any person may make a submission in writing to the Trust in relation to these criteria.

Licences

A licence grants to a licensee the non-exclusive use of land or premises.
Licences permit entry upon Trust land at times and under conditions approved by the Trust to:

  • The Trust may grant a licence to a licensee for the purposes of: Maintaining, re-laying or repairing existing pipelines or cables;

  • Repairing services that traverse Trust lands through to neighbouring lands owned by other organisations;

  • Temporary construction access; and

  • Temporary venue hires or other commercial purposes.

Requests for licences associated with repair works or construction works, should be made in writing to the Trust, and must satisfy one or more of the following criteria:

  • Supporting the Government supply of services and utilities;

  • Supporting the supply of service to owners of neighbouring lands;

  • the proposal will leave no permanent impact on the physical structures or visual amenity of the Trust lands; and

  • the proposal must comply with legislative safety and environmental requirements.

Requests for licences associated with temporary venue hire or other such commercial purpose should be made in writing to the Trust, and must satisfy one or more of the following criteria:

  • Enhancement of the educational, historical, cultural or recreational value of Trust lands’

  • Integration of Trust activities with the wider social or cultural life of the State;

  • Compliance with legislative safety and environmental requirements;

  • the event must not leave any permanent impact on the physical structure or visual amenity of the Trust lands;

  • Demonstration of consistency with core activities and objectives of the Trust;

  • the proposal must meet an appropriate standard of service delivery; and

  • the proposal should provide a commercial return to the Trust if appropriate.

Significant proposed cultural events and activities are referred to the Trust's Arts Advisory Panel. This panel consists of staff representatives, a member of the Trust, an external expert appropriate to the particular cultural or art form being considered, and local experts/stakeholders as necessary.

The Panel advises the Director, Executive and Trust on the suitability of cultural activities or events for all Trust lands. The Panel advises on matters of artistic taste and merit, and provides comment and advice on context, suitability and risk management.

Easements

An easement allows another person or entity to use lands owned by another person or entity without any right of ownership or possession. The most common forms of easements are rights of way and easements for services, such as water, electricity or sewerage.

In the case of the Trust lands, the Trust may grant easements across Trust lands to:

  • Construct pipelines or lay cables;

  • Provide access to dwellings adjacent to Trust lands; or

  • Support the attainment of Trust objectives.

Requests for easements must satisfy one or more of the following criteria:

  • Supporting the Government supply of services and utilities;

  • Supporting the supply of service to owners of neighbouring lands;

  • Providing access to owners of neighbouring lands;

  • Minimise the impact on the physical structure and visual amenity of Trust lands;

  • the proposal must comply with legislative safety and environmental requirements; and

  • the proposal must demonstrate consistency with the core activities and objectives of the Trust.
