RBGDT Education and Engagement Centre Programs Terms and Conditions

1. Rates

a. Annual Rates
Rates will be reviewed and updated at least each financial year.

b. Quotes
A quote is only applicable for the period within the financial year in which it was given. Rates are subject to change each financial year and increases may apply. Where a quote is issued for the upcoming financial year, any price increases will apply.
2. Bookings and Payment
a. Online Tickets
Purchase of a ticket online is final. Participants are required to bring a soft or hard copy of their online booking confirmation to the activity.

b. Groups (Schools, Vacation cares and Private Bookings)
Group bookings are made via an RBGDT Booking Officer through an online form (schools) or via email (other groups). A booking confirmation will be sent upon completion of a group booking and constitutes a formal booking, which will be invoiced upon completion of the activity.
  
Payment is required within 30 days upon receipt of an invoice. Cash and cheque payments are not accepted. Payment may be made by credit card and direct debit only.
3. Refunds, Cancellations and Booking Changes

The Royal Botanic Gardens and Domain Trust (RBGDT) reserves the right to cancel any event in case of extreme weather or if minimum participation numbers are not met.

a. Wet Weather
All booked programs will go ahead in wet weather, unless it is an extreme weather condition. See the Extreme Weather Guidelines for more information.

b. Online tickets
No refunds apply for cancellation of tickets purchased online.
A request for a date change can be made in writing no less than 48 hours prior to the program commencement time. Approval of a date change is at the discretion of the RBGDT.

c. School & Vacation Care Bookings
We require notice in writing at least eight (8) business days prior to the booked session for cancellations, number changes and rescheduling requests, unless it is due to extreme weather condition.
   i. Cancellations (including change of date) received less than eight (8) business days prior to the booked session, and ‘no shows’ will incur a cancellation fee of the minimum charge per hired educator.
   ii. Requests to change the number of booked participants received less than eight (8) business days prior to the booked session will incur the minimum charge per group/class or the charge per attending participant, whichever is greater.
   iii. In the case of COVID-19, a school or vacation care is required to inform RBGDT in writing as soon as possible if their booking is affected by a Stay at Home order or if under an isolation order from NSW Health. 

d. Group Bookings (except schools)
Where a cancellation is requested within 48 hours of the booking commencement time, a cancellation fee will apply, unless it is due to extreme weather condition.
   i. Cancellations (including change of date) received less than 48 hours (or two business days, whichever is greater) prior to the booked session, and ‘no shows’ will incur a cancellation fee of the minimum charge per hired educator.
   ii. Requests to change number of booked participants received less than 48 hours (or two business days, whichever is greater) prior to the booked session will incur the minimum charge per group/class or the charge per attending participant, whichever is greater.
   iii. In the case of COVID-19, groups are required to inform RBGDT in writing as soon as possible if their booking is affected by a Stay at Home order or if under an isolation order from NSW Health. 
 
e. Extreme Weather
Despite other clauses, if an extreme weather condition under the Extreme Weather Guidelines occurs,
  1. RBGDT may in accordance with the Guidelines:
    1. cancel or modify the event without incurring any liability to the participating group, subject to paragraph (v);
    2. hold the event at a different date if an agreement has been reached between RBGDT and the participating group, by providing a notice of Extreme Weather to the participating group, as soon as practicable.
  2. The participating group shall notify RBGDT, as soon as practicable, if it considers that the event needs to be cancelled or modified due to any health conditions of any participants affected by or in relation to any extreme weather condition.
    For avoidance of doubt, the participating group may not cancel or modify the event without RBGDT’s approval.  
  3. the notice issued under paragraph (i) and (ii) needs to include:
    1. the nature of the extreme weather condition;
    2. to the extent assessable, the expected duration of the extreme weather condition;
    3. the event affected by the extreme weather condition and the extent to which the event needs to be modified or cancelled.
  4. the participating group is responsible for its participants’ health, wellbeing and safety. The participating group will identify any of its participants who have a health condition that would be adversely affected by any weather condition, and withdraw some or all of its participants from the event, subject to RBGDT’s approval.
  5. If an event is cancelled due to an extreme weather condition, RBGDT will refund any payments made by the participating group to RBGDT, deducting any administration fee or any other non-refundable costs incurred in relation to the event.
